This document is a public offer (“Agreement”) between DARK by Rior (“Seller”, “we”, “our”) and any individual or entity who makes a purchase on our website (“Customer”, “you”). By placing an order on our website, you accept this Agreement.
1. General Provisions
1.1. The Seller operates an online store that offers nail products and related goods.
1.2. This Agreement is made in accordance with the Israeli Consumer Protection Law, 5741-1981, the Electronic Commerce Regulations, and other applicable legislation.
1.3. By using our website or purchasing products, you agree to the terms described here.
2. Subject of the Agreement
2.1. The Seller undertakes to supply the products ordered on the website, and the Customer undertakes to pay for them in accordance with the terms of this Agreement.
2.2. Product descriptions, prices, delivery options, and payment terms are published on the website and form part of this Agreement.
3. Ordering and Conclusion of Agreement
3.1. Orders are placed through our website by selecting products, adding them to the shopping cart, and completing the checkout process.
3.2. The Agreement is considered concluded once the Customer receives an order confirmation from the Seller by email, SMS, or another communication method.
3.3. The Seller reserves the right to refuse an order in case of lack of stock, incorrect data provided by the Customer, or non-payment.
4. Prices and Payment
4.1. Prices are listed in Israeli New Shekel (ILS) and include VAT (if applicable).
4.2. Payment options:
- Online card payment (Visa, Mastercard, Apple Pay, Google Pay)
- Cash upon receipt (if available in the selected delivery option)
4.3. The order must be fully paid according to the chosen payment method.
5. Delivery
5.1. Delivery is carried out throughout Israel.
5.2. Free delivery applies to orders over 500 ILS. Orders below this amount are charged according to carrier rates.
5.3. Delivery is carried out by our couriers or postal services to ensure products arrive safely and on time.
5.4. Delivery times are indicative and depend on logistics providers. The Seller is not liable for delays beyond its reasonable control.
6. Returns, Exchanges & Cancellations
6.1. In accordance with the Consumer Protection Law, cosmetic products, once opened, cannot be returned due to health and hygiene reasons.
6.2. If the product is defective, damaged upon delivery, or does not match the order, the Customer must notify the Seller within 14 days of receipt, and the Seller will offer replacement or refund as required by law.
6.3. To request a return, please contact us via email/phone (see Contact section). Products must be unused, unopened, and in original packaging.
6.4. Refunds will be issued within the timeframe required by Israeli law, to the original payment method.
7. Product Safety & Certification
7.1. All DARK products are tested and approved by the Israeli Ministry of Health.
7.2. As of September 1, 2025, the ingredient TPO (Trimethylbenzoyl Diphenylphosphine Oxide) is banned in the European Community.
7.3. DARK formulas have replaced TPO with TPO-L (Ethyl Trimethylbenzoyl Phenylphosphinate), which is approved in the EU and Israel.
7.4. Products are certified according to both Israeli and European standards.
7.5. Some formulas may contain NEMA – intended for professional use only.
8. Warranties & Liability
8.1. The Seller guarantees that the products comply with the specifications stated on the website.
8.2. The Seller is not responsible for:
- Improper use of the products by the Customer
- Allergic reactions caused by individual sensitivity
- Delays or failures caused by third-party logistics providers
8.3. The Seller’s liability shall not exceed the value of the order in dispute.
9. Intellectual Property
9.1. All trademarks, logos, images, and texts on the DARK by Rior website are the property of the Seller and may not be used without prior written consent.
10. Working Hours
10.1. The DARK by Rior store operates daily from 08:00 to 20:00.
10.2. Customer service is available during working hours via phone, email, or online chat.
11. Governing Law & Jurisdiction
11.1. This Agreement is governed by the laws of the State of Israel.
11.2. Any disputes shall be resolved amicably; if no agreement is reached, the dispute shall be submitted to the competent courts in Israel.
